Today, the world is facing many global crises and challenges. In order to limit negative environmental and social impacts, human being had put forward the concept of sustainable development, set goals and taken actions to advance the process of sustainable development. However, scholars’ research on sustainable development mainly focuses on the three major aspects: economy, society and environment/ecology. Only a few articles talked about culture and sustainable development. In order to further promote the development of human high-quality life and the (...) construction of sustainable development, it must consider the relationship between culture and sustainable development. Therefore, the thesis raises two research questions: 1. What is the connection and contribution of culture to the sustainable development according to the scholars’ research on sustainable development in the past? 2. How can culture contribute to sustainable development? The first part of this thesis introduced the background, significance, and the objectives of the research. Then, the second part defined the concept of “culture” discussed in this research, which referred to all the spiritual activities of mankind and its products. Culture explains the core problems of kinds of issues being produced, sent, communicated, accepted, understood, and mutated to people, and all kinds of cultural forms are the basic methods of providing human communication and studying things. viii These products and activities were divided into two kinds, the material culture and non-material culture. Material culture was an entity that existed, it presented culture in a physical, perceptible and measurable form while non-material culture included symbols, values, cultural norms and people’s way of life, it was abstract and constantly inherited. The third part was to introduce the process of culture development through Sichuan cuisine’s development. Culture itself had the characteristics of development and inheritance, but to achieve the sustainable development of culture, it required planning and strategy. Consequently, the author combed the milestone of culture development in the process of sustainable development, sorting out the characteristics of sustainable development culture, that required sustainable development culture were: people-based, participation-based, systematic, pluralistic, dynamic, integrated, confident and responsible. The third part used two methods to analyze the literature that met the search criteria in Web of Science from 1900 to 2020. The first was Occurrence, resulted in 11463 results, finding that the most studied areas of sustainable development were environmental science, green sustainable science technology and environmental studies, which meant research on culture and sustainable development was a weak subject compared to other areas. The second was Co-occurrence, resulted in 52 review articles, then used the method of the systematic literature review to analysis. Lastly, these 52 articles were analyzed by the systematic literature review (SLR) approach, and then ix divided into four categories and were the focus of this article. The first category directly discussed the relationship between culture and sustainable development; the second category discussed of the single culture in sustainable development; the third category was the development of culture in specific circumstance in the context of sustainable development; and in the fourth category, “culture” meaning cultivation, not related to the culture this paper discussed about. From the above analysis for 52 articles, the following findings and discussing are discovered: in sustainable development, the definition of culture is too broad and then requires a concept of “culture”, which can be adapted to various disciplines and applied to sustainability research. Culture needs to be and should be a pillar of sustainable development. Culture can be in, for, as sustainable development. Culture is not only an artistic and creative activity, but also concerned with the relationship with nature and a broader social issue. The power of culture in sustainable development cannot be ignored, it can not only play in the other pillars of sustainable development, but also can eventually form a sustainable development culture, to change people’s way of life, behavior and mind, so that human beings can be better and more sustainable development. Precision medicine and molecular systems medicine (MSM) are highly utilized and successful approaches to improve understanding, diagnosis, and treatment of many diseases from bench-to-bedside. Especially in the COVID-19 pandemic, molecular techniques and biotechnological innovation have proven to be of utmost importance for rapid developments in disease diagnostics and treatment, including DNA and RNA sequencing technology, treatment with drugs and natural products and vaccine development. The COVID-19 crisis, however, has also demonstrated the need for systemic thinking and transdisciplinarity and the limits (...) of MSM: the neglect of the bio-psycho-social systemic nature of humans and their context as the object of individual therapeutic and population-oriented interventions. COVID-19 illustrates how a medical problem requires a transdisciplinary approach in epidemiology, pathology, internal medicine, public health, environmental medicine, and socio-economic modeling. Regarding the need for conceptual integration of these different kinds of knowledge we suggest the application of general system theory (GST). This approach endorses an organism-centered view on health and disease, which according to Ludwig von Bertalanffy who was the founder of GST, we call Organismal Systems Medicine (OSM). We argue that systems science offers wider applications in the field of pathology and can contribute to an integrative systems medicine by (i) integration of evidence across functional and structural differentially scaled subsystems, (ii) conceptualization of complex multilevel systems, and (iii) suggesting mechanisms and non-linear relationships underlying the observed phenomena. We underline these points with a proposal on multi-level systems pathology including neurophysiology, endocrinology, immune system, genetics, and general metabolism. An integration of these areas is necessary to understand excess mortality rates and polypharmacological treatments. In the pandemic era this multi-level systems pathology is most important to assess potential vaccines, their effectiveness, short-, and long-time adverse effects. We further argue that these conceptual frameworks are not only valid in the COVID-19 era but also important to be integrated in a medicinal curriculum. (shrink)

My aim is to extend and complement the arguments that others have already made for the claim that women who are citizens of economically disadvantaged states and who have been trafficked into sex work in economically advantaged states should be considered candidates for asylum. Familiar arguments cite the sexual violence and forced labor that trafficked women are subjected to along with their well-founded fear of persecution if they’re repatriated. What hasn’t been considered is that reproductive rights are also at stake. (...) I explain how reproductive rights are implicated in sex trafficking. Moreover, I contend that sex traffickers’ abuse of women’s reproductive rights is persecutory and that that this persecutory abuse obliges destination states to offer asylum to transnational sex trafficking victims. I start by sketching reproductive human rights doctrine. I then examine studies of women who are in post-trafficking recovery programs in order to ascertain the impact of their past experience of forced sex work on their reproductive freedom and health. On the basis of these findings, I maintain that, among other outrages, sex trafficking systematically violates victims’ reproductive human rights. In view of this abuse, women trafficked into sex work might seem to be prime candidates for asylum in destination states. Yet, economically well-off destination states are not particularly receptive to this idea, and international law provides some justification for their chilliness. Preliminary to challenging them, I explicate four ways in which international anti-trafficking law and international refugee law interfere with viewing women trafficked into sex work as refugees and approving their applications for asylum. The second half of my paper aims to overcome those legal obstacles. In the interest of parsimony and because there are many continuities between U.S. refugee law and anti-trafficking law and the policies of similar destination states, I focus mainly on the U.S. in this part of the paper. To anchor my argument, I spotlight two precedents in refugee law for taking reproductive human rights seriously and several precedents for treating trafficked women as members of a distinct social group as required by refugee law. I then urge that a law enforcement gestalt has gained undue influence over U.S. legal practices where anti-trafficking law intersects with refugee protection law. A human rights gestalt is needed as a counterweight, for otherwise victims of sex trafficking and the reproductive abuse they’ve suffered are erased. Taking up a human rights perspective and mobilizing the precedents I’ve identified, I show that respecting the reproductive human rights of women who have been trafficked into sex work entails that affluent destination states must recognize their right to asylum. ArgumentIn the United States, scientific knowledge is brought before the courts by way of testimony – the testimony of scientific experts. We argue that this expertise is best understoodfirstas related to the quality of the underlying scienceand thenin terms of who delivers it. Bloodstain pattern analysis (BPA), a contemporary forensic science, serves as the vaulting point for our exploration of objectivity as a metric for the quality of a science in judicial contexts. We argue that BPA fails to meet the (...) minimal standard set by Helen Longino’s social-procedural account of objectivity (1990, 2002). In light of some pressing issues for social-procedural accounts, we offer an infrastructural account of objectivity. This account offers what amounts to a friendly amendment to Longino’s account and adds to the ways in which we might analyze social-procedural objectivity. Finally, we address an issue that is pressing in the legal context: given that scientific knowledge is delivered by individuals, not communities, at least in U.S. courts, we (may) need a way to evaluate individual scientific and epistemic agents. We suggest a means for making this evaluation that is derived from our infrastructural account of objectivity. (shrink)

A remarkable event occurred at the December 3, 2004, meeting of the U. S. President’s Council on Bioethics. Council member William Hurlbut, a physician and Consulting Professor in the Program in Human Biology at Stanford University, formally unveiled a proposal that he claimed would solve the ethical problems surrounding the extraction of stem cells from human embryos. The proposal would involve the creation of genetically defective embryos that “never rise to the level of integrated organismal existence essential to be designated (...) human life with potential,” and therefore could be used as morally acceptable sources of stem cells for research and therapy. The aim of this essay is to show that Hurlbut’s proposal does not solve the ethical problems associated with human embryonic stem cell research. Two major reasons are presented. First, the proposal, which involves modification of a somatic cell nucleus, suffers from an ethical problem that is common to all types of human genetic engineering: since the procedure is not foolproof, there will be failures. In the case of the procedure Hurlbut proposes, some normal (albeit cloned) embryos will be produced. Second, the embryo engineered in the manner described is, at least in the early stages of its development, fully human despite its genetic defect. This essay also will show how a reasonable person might mistakenly view the proposal as legitimate if he or she makes the error of conflating genetic determinism with Aristotelian teleology. Finally, it will argue that ethical clarity can be achieved by seeing the embryo as a holistic entity possessing emergent properties that cannot simply be spelled out by genes. (shrink)

This paper is about teaching philosophy to high school students through Lincoln-Douglas (LD) debate. LD, also known as “values debate,” includes topics from ethics and political philosophy. Thousands of high school students across the U.S. debate these topics in class, after school, and at weekend tournaments. We argue that LD is a particularly effective tool for teaching philosophy, but also that LD today falls short of its potential. We argue that the problems with LD are not inevitable, and we offer (...) strategic recommendations for improving LD as a tool for teaching philosophy. Ultimately, our aim is to create a dialogue between LD and academic philosophy, with the hope that such dialogue will improve LD’s capacity to teach students how to do philosophy. (shrink)

Imagine both that (1) S1 is deliberating at t about whether or not to x at t' and that (2) although S1’s x-ing at t' would not itself have good consequences, good consequences would ensue if both S1 x's at t' and S2 y's at t", where S1 may or may not be identical to S2 and where t < t' ≤ t". In this paper, I consider how consequentialists should treat S2 and the possibility that S2 will y at (...) t". At one end of the spectrum, consequentialists would hold that, in deciding whether or not to x at t', S1 should always treat S2 as a force of nature over which she has no control and, thus, treat the possibility that S2 will y at t" as she would the possibility that a hurricane will take a certain path. On this view, S1 is to predict whether or not S2 will y and act accordingly. At the other end of the spectrum, consequentialists would hold that S1 should always treat S2 as someone available for mutual cooperation and, thus, treat the possibility that S2 will y at t" as something to be relied upon. On this view, S1 is to rely on S2’s cooperation and so play her part in the best cooperative scheme involving the two of them. A third and intermediate position would be to hold that whether S1 should treat S2 as a force of nature or as someone available for mutual cooperation depends on whether S1 can see to it that S2 will y at t" by, say, having the right set attitudes. I’ll argue for this third position. As we’ll see, an important implication of this view is that consequentialists should be concerned not just with an agent’s voluntary actions but also with their involuntary acquisitions of various mental attitudes, such as beliefs, desires, and intentions. Indeed, I will argue that consequentialists should hold both that (1) an agent’s most fundamental duty is to have all those attitudes that she has decisive reason to have and only those attitudes that she has sufficient reason to have and that (2) she has a derivative duty to perform an act x if and only if her fulfilling this fundamental duty ensures that she x’s. Thus, I argue (as Donald Regan did before me) that consequentialism should not be exclusively act-orientated – that it should require agents not only to perform certain voluntary actions but also to have certain attitudes. In the process, I develop a new version of consequentialism, which I call attitude-consequentialism. Public discourse is often caustic and conflict-filled. This trend seems to be particularly evident when the content of such discourse is around moral issues (broadly defined) and when the discourse occurs on social media. Several explanatory mechanisms for such conflict have been explored in recent psychological and social-science literatures. The present work sought to examine a potentially novel explanatory mechanism defined in philosophical literature: Moral Grandstanding. According to philosophical accounts, Moral Grandstanding is the use of moral talk to seek social (...) status. For the present work, we conducted six studies, using two undergraduate samples (Study 1, N = 361; Study 2, N = 356); a sample matched to U.S. norms for age, gender, race, income, Census region (Study 3, N = 1,063); a YouGov sample matched to U.S. demographic norms (Study 4, N = 2,000); and a brief, one-month longitudinal study of Mechanical Turk workers in the U.S. (Study 5, Baseline N = 499, follow-up n = 296), and a large, one-week YouGov sample matched to U.S. demographic norms (Baseline N = 2,519, follow-up n = 1,776). Across studies, we found initial support for the validity of Moral Grandstanding as a construct. Specifically, moral grandstanding motivation was associated with status-seeking personality traits, as well as greater political and moral conflict in daily life. (shrink)

On September 7, 2008 the executive administration of American President George W. Bush announced that his government would take over the giant mortgage finance companies Fannie Mae and Freddie Mac, costing the citizens $200 billion. One week later, the 160 year-old American investment bank Lehman Brothers filed for the largest bankruptcy in U.S. history. What would soon be known worldwide as “the financial crisis” had begun. In response to that crisis, less than a month later, on October 3, 2008, the (...) United States Congress passed the Emergency Economic Stabilization Act of 2008, which established the Troubled Asset Relief Program and authorized the use of $700 billion in taxpayer funds to bail out the banking and finance industry. As a result, the U.S. Treasury reports that the total bailout gave Bank of America $45 billion, Citigroup Bank $45 billion, AIG Bank $40 billion, J. P Morgan $25 billion, Wells Fargo $25 billion, General Motors $10.4 billion, Goldman Sachs $10 billion, Morgan Stanley $10 billion, GMAC $5 billion, and Chrysler corporation, a mere $4 billion. This response to a perceived crisis was not limited to the United States. On October 12, 2008—in one day alone—the United Kingdom coughed up the equivalent of €679 billion in bank relief. And in Germany, Der Spiegel reported on December 23, 2008 “The German government whipped its €480 billion bank bailout package through parliament in record time.". (shrink)

The idea of permit trading in the United States can be traced as far back as the 1970s, but emissions trading has really only became a popular and exportable idea with the more recent demands that environmental protection acknowledge economic pressures through such ideas as sustainable development. Now the idea of emissions trading has caught on in South America, China and Europe as well. Yet in the eagerness of governments and industry to work out the technical details and legal mechanics (...) of the emissions trading tool, insufficient attention has been paid to its underlying legal and ethical assumptions. In this article, it is emphasized that emissions trading is a part of compliance with environmental law, not a market alternative to compliance. The difference between the two greatly effects and is affected by theories of rights. As part of the scheme of rights and accompanying duties, the author questions whether an implicit right to pollute has been created through emissions trading, as exemplified by the comparison of the systems in the U.S., China and Europe. Discerning the decisionmaking of Kim Jong-Un and the North Korean regime on issues of peaceful engagement and warlike actions endures as a mighty challenge for U.S. intelligence analysts and policymakers. In this report, we seek to inform analysis of Democratic People’s Republic of Korea (DPRK) leadership decisionmaking. To do so, we use three discussion papers that were written to facilitate discussion of an interagency working group. The three papers are assembled here in a single report. The first discussion paper describes (...) decisionmaking among different authoritarian regimes, including North Korea, and the opening up of those economies to outside engagement. The second paper outlines two different scenarios that might occur when conventional deterrence on the Korean Peninsula breaks down and the resulting decisions that North Korea’s leadership could face. The third paper assesses DPRK decisionmaking about nuclear weapon use. The report concludes with some observations, drawn from the issues covered in these three discussion papers, about DPRK decisionmaking and stability on the Korean Peninsula. (shrink)

Protagoras u Sekstusa Empiryka (PH I 216) a platoński Teajtet Dzieła Sekstusa Empiryka stanowią ważne źródło doksograficzne, zawierając m. in. fragmenty i przekazy poświęcone sofistyce. Są wśród nich omówienia poglądów Protagorasa. W świetle problemów, jakie stwarza rekonstrukcja myśli tego sofisty, warto poddać badaniu źródła i perspektywę Sekstusa, zwracając szczególną uwagę na krótkie przedstawienie tez Protagorasa zawarte w Zarysach Pyrrońskich (PH I 216). Porównując omówienie Sekstusa i przedstawienie Platona w Teajtecie, dostrzec możemy podobieństwo prezentowanych poglądów. W przekazie Seksusa podobnie jak w (...) Teajtecie główny akcent położony jest na tezę homo-mensura, z którą wiąże się dwa inne podstawowe dla platońskiego dialogu wątki: zmienności rzeczy oraz "prywatności" spostrzeżeń. Mimo charakterystycznej dla sceptycyzmu modyfikacji strony pojęciowej, nadinterpretacji oraz wyrwania tez z dialogowego kontekstu przedstawienia obu wątków wykazują daleko idące paralele z Teajtetem. Bez względu na to, czy omówienie to jest dziełem samego Sekstusa, czy zaczerpnięte zostało z jakiegoś wcześniejszego źródła mającego charakter sceptycznej "ściągawki", możemy na jego podstawie wnioskować, że dialog Teajtet uważany był w późnej starożytności za wiarygodne źródło informacji na temat poglądów Protagorasa. Należy jednak podkreślić, że przekaz Sekstusa stanowi jedynie interpretację treści zawartych w platońskim Teajtecie i – wbrew praktyce wielu uczonych - nie może być brany pod uwagę jako niezależne źródło wiedzy o myśli Protagorasa. The paper analyses not well known beginning of Cracow philosophy of nature originating from the 19th century. A selected number of issues formed by two founders of Cracow philosophical centre – W. Heinrich and M. Straszewski are presented. Finally, the author tries to refl ect on modern nature philosophy in the context of its relations with tradition lasting over the centuries.

The contribution focuses on philosophical issues of justice of positive law in the light of the social teaching of John Paul II. The analyses start with consideration of anthropological foundations of justice as virtue, develop with the reflexion upon justice of actions realizing justice and finally arrive at examination of the criteria of justice of law. -/- It is argued that relations between a human being and goods (ends of actions) form ontological basis of natural law and justice of actions (...) – orders and prohibitions are secondary in respect to these relations. An aim of just law (and natural law) is not preservation or restoration of abstractly understood moral order based on norms – orders and prohibitions) but integral development (good) of a person – a being possessing dignity. John Paul’s II philosophy of law takes advantage primarily of Thomas Aquinas’ approach to law and combines it with constructions which are typical for modern human rights protection. John Paul’s II conception of natural law is anthropocentric and bases on subjective rights thinking. Human dignity and human rights which derive from it provide basic criteria for the justice of law. Human rights as subjective rights disclose natural law which is understood as a set of goods for a human person. These goods are ends of actions and as such they determine actions and their forms. This point of view is compatible with Aquinas’ definition: “law is nothing but a rational plan of operation, and … the rational plan of any kind of work is derived from the end” (Summa contra gentiles, lib. 3, cap. 114, n. 5). -/- Positive (human) law which is not just has no normative power in this sense that it does not in itself provide reasons for concrete actions of a concrete actor. Sometimes there are moral reasons for following unjust law, however if its norm prescribes actions which are wrong in themselves (internally wrong) there is moral obligation to act contrary to such a legal norm. -/- Zasadniczym przedmiotem opracowania jest filozoficzna refleksja Jana Pawła II nad sprawiedliwością prawa stanowionego. Analizy przebiegają od zagadnienia antropologicznych podstaw sprawiedliwości poprzez problematykę działań realizujących sprawiedliwość do zagadnienia sprawiedliwości prawa stanowionego. Opracowanie zamykają uwagi wskazujące na kontekst teologiczny istotny dla problematyki sprawiedliwości, którego analiza wykracza jednak poza podjęte zamierzenie koncentrujące się na problematyce filozoficznoprawnej. Argumentuje się, że u podstaw tej refleksji leży namysł nad relacją człowieka do dobra, która stanowi ontologiczną podstawę prawa naturalnego i sprawiedliwości – nakazy i zakazy są wtórne wobec tej relacji. Celem prawa i sprawiedliwości jest dobro konkretnego, obdarzonego godnością człowieka, a nie np. przywracanie abstrakcyjnie pojętego porządku moralnego. Od strony konstrukcji teoretycznej, filozofia prawa Jana Pawła II jest osadzona przede wszystkim na koncepcji Tomasza z Akwinu łączonej z konstrukcjami typowymi dla współczesnej ochrony praw człowieka. To w godności i wynikających z niej prawach człowieka poszukiwać trzeba zasadniczych treściowych kryteriów sprawiedliwości prawa. Prawa człowieka jako prawa podmiotowe są podstawowym wyrazem prawa naturalnego, stanowiącego ontyczną podstawę sprawiedliwości i które pojmowane jest jako zespół dóbr dla osoby, zatem i celów kształtujących działanie. Perspektywa pojmowania prawa naturalnego jest antropocentryczna. Prawo stanowione, które nie jest sprawiedliwe, nie ma „mocy prawa”, przede wszystkim w takim sensie, że nie stanowi samo w sobie racji działania. Niekiedy, ze względów moralnych, niesprawiedliwe prawo wymaga posłuszeństwa. Jeśli jednak prawo stanowione daje uprawnienia do czynów wewnętrznie złych i nakazuje takie czyny, to nie tylko nie obowiązuje w sumieniu i nie jest racją działania, ale obowiązkiem jest postępowanie wbrew takiemu prawu. [PERSONHOOD IN AFRICAN PHILOSOPHY]. W artykule została omówiona i poddana analizie debata między dwoma współczesnymi afrykańskimi filozofami Ifeanyim A. Menkitim z Nigerii oraz Kwame Gyekyem z Ghany. Debata ta dotyczy typowych dla niektórych afrykańskich kultur sposobów myślenia o istocie człowieczeństwa, tj. o byciu człowiekiem (osobą, person). Prezentowane przez tych filozofów koncepcje nie odnoszą się do żadnych konkretnych afrykańskich ludów, lecz raczej są pewnymi wzorcami idealnymi, czy też abstrakcyjnymi. Zdaniem Menkitiego w tradycyjnym myśleniu afrykańskim jednostka (individual) stopniowo nabywa pełnię człowieczeństwa w (...) oczach swojej wspólnoty wpierw poprzez internalizację obowiązujących w niej norm, a następnie przez ich przestrzeganie w dorosłym życiu. Jak wskazuje, Afrykanin jest przy tym człowiekiem bardziej w przekonaniu i w odbiorze innych niż w swoim własnym. Ale nawet jego własne przeświadczenie o byciu człowiekiem jest kreowane przez myślenie zbiorowe. Z taką perspektywą nie zgadza się Gyekye, który uważa, że człowieczeństwo nie jest u Afrykanów czymś konstytuowanym bądź potwierdzanym przez zbiorowość. W przekonaniu Gyekyego, w myśleniu afrykańskim człowieka czynią pewne symptomatyczne dlań z natury atrybuty fizyczne i umysłowe oraz towarzyszący im instynkt społeczny (sociality), który, jak mniema, jest również przyrodzony. Choć Afrykanin jest, według Gyekyego, bytem głęboko wspólnotowym, posiada również pewien potencjał niezależności od wspólnoty (lokalnej, etnicznej, religijnej), której jest członkiem. Z opisu Menkitiego wynika zaś, że przeciętny Afrykanin nie jest aktywnym sprawcą rzeczywistości i indywidualnym interpretatorem świata, w którym żyje. Artykuł opublikowany w: "Przegląd Filozoficzny. Od końca XX wieku w Europie rozwija się instytucja ponadpaństwowego obywatelstwa europejskiego, które obecnie pozostaje komplementarne wobec członkostwa jednostki w strukturze państwa. Obywatelstwo związane jest głównie z państwem, zarówno genetycznie, jak i funkcjonalnie, zaś proces kształtowania się idei obywatelstwa i jej prawnego urzeczywistniania leży w cywilizacji europejskiej głęboko u początków państwowości. Podkreślić należy przy tym, iż to wydarzenia końca XVIII wieku we Francji bezsprzecznie dodały rozwojowi idei obywatelstwa nowej dynamiki, prowadząc do jej nowożytnej instytucjonalizacji. Przez stulecia porządek prawny panujący w (...) państwach europejskich determinował bowiem posiadanie przez jednostkę praw, które wynikały z jej przynależności do danej grupy społecznej (kręgu wolno urodzonych, grona zamożnych, czy danego stanu). Dopiero akty prawne doby Rewolucji Francuskiej wprowadziły kategorię praw podmiotowych jednostki. Słusznie przyjęło się uważać, iż Rewolucja Francuska stworzyła „nowego człowieka” − obywatela. Nieczęsto jednak zwraca się uwagę na fakt, iż burzliwe wydarzenia końca XVIII wieku we Francji doprowadziły do powstania różnych wzorców obywatela, zaś wszystkie one razem stały się podstawą dla prawnego urzeczywistnienia obywatelstwa państwowego w Europie. Podstawy ideologiczne gruntownych przemian dawała twórczość wielkich myślicieli Oświecenia, zwłaszcza zaś poglądy wyrażane przez Monteskiusza i Jana Jakuba Rousseau. Nie bez znaczenia pozostawały również społeczno-polityczne oraz gospodarcze koncepcje przedstawicieli szkoły fizjokratów i encyklopedystów (czy nawet utopijnych komunistów). Intelektualiści epoki proponowali kierunki zmian często zasadniczo od siebie odmienne, ale zawsze – teoretycznie przynajmniej – lepsze od stanu rzeczywistego. Przelewane na papier wizje uznanych pisarzy podsycały ogólny klimat niezadowolenia i przyspieszały dojrzewanie rozwiązań radykalnych. Intelektualna krytyka istniejącego status quo prowadziła wprost do przełomu, który miał uzbroić człowieka w więcej praw, poszerzyć horyzonty jego wolności i przekształcić poddanego w obywatela. Afryka postkolonialna była, jest i będzie targana konfliktami o naturze separatystycznej. Najsłynniejsze już próby secesji w Afryce to przypadki Katangi (w latach 1960–1963) oraz Biafry (w latach 1967–1970). Wojna w Erytrei (w latach 1961–1991) to jedyny jak dotąd afrykański konflikt separatystyczny, który skończył się ustanowieniem nowego państwa (1993 rok). Charakter separatystyczny mają również dwa krwawe konflikty w Sudanie Południowym (w latach 1961–1972 i 1983–2005). Od 1975 roku aż do dzisiaj Etiopia zmaga się ze zbrojnym separatyzmem w Ogadenie. Irredentystyczna idea budowy (...) Wielkiej Somalii, tj. zjednoczenia w jednym państwie wszystkich Somalów, leżała u podłoża wojny, jaką w Ogadenie stoczyły ze sobą Etiopia i Somalia w latach 1977–1978. W 1981 roku wybuchł konflikt w północnej Somalii, która w 1991 roku ogłosiła niepodległość jako Somaliland. Choć krajowi temu brakuje uznania międzynarodowego, Somaliland posiada wszelkie inne atrybuty państwa, w przeciwieństwie do pozostającej od lat w stanie upadku Republiki Somalii. To tylko niektóre z, często już historycznych, przykładów zbrojnego separatyzmu na kontynencie afrykańskim – te najbardziej krwawe czy długotrwałe. Zbrojny separatyzm obecny jest jednak współcześnie w wielu innych miejscach Afryki. Prawie każde położone na południe od Sahary państwo tego kontynentu posiada potencjalne warunki do rozwoju separatyzmu. Przebieg niemal wszystkich granic w Afryce został arbitralnie ustanowiony przez mocarstwa kolonialne jeszcze w XIX wieku. Większość granic dzieli jakiś lud na nominalnych obywateli różnych organizmów państwowych. Z drugiej strony w granicach jednego państwa zamieszkuje niejednokrotnie wiele ludów o odmiennym pochodzeniu etnicznym oraz różnej kulturze i wierzeniach. Wieloetniczność i różnorodność kulturowa nie są same w sobie przyczynami dążeń separatystycznych, choć zwykle stanowią dla nich bardzo ważne podłoże. (shrink)

Tekst bada naturę i siłę tej inspiracji. Część pierwsza opowiada historię powstania Von der mannigfachen … oraz przedstawia szerszy kontekst zetknięcia się Heideggera z filozofią Brentana, a także stara się przedstawić Heideggera na tle jego pozostałych uczniów (Kazimierz Twardowski, (...) Edmund Husserl, Alexius Meinong, Carl Stumpf, Anton Marty, et al.). Część druga omawia piętnaście tez o bycie, które stanowią sedno dzieła O wielorakim znaczeniu bytu u Arystotelesa i tym samym umożliwia porównanie tomistycznej w duchu ontologii Brentana z ontologią fundamentalną Heideggera, o czym traktuje część trzecia. In the first part of his magnum opus Hans Urs von Balthasarpresents his project of theological aesthetics where the experience of art becomes an entrance to a religious act and an ennobling way leading to the contemplation of God. Defining the essence of being human as a spiritual being directed towards God bears a deep ethical meaning in this consideration. H.U. von Balthasar’s reflection over the religious dimension of the essence of art is shaped within theology but at the same (...) time in the opposition to aesthetic theology which is de-scribed as ‘aesthetisation’ of the Mystery of Revelation. The art of music occupies a particular place in this reflection. For this reason Mass in B Minor BWV 232 by Johann Sebastian Bach, which is an emblematic example of the revelation of the glory of the Lord (Herrlichkeit), will be analysed not only from the perspective of philosophical or musicological aesthetics, but also theological aesthetics. This article outlines characteristic features of theological aesthetics specifically developed from traditional philosophical aesthetics whose range was extended by the human being’s relation to God. Das Problem, wie der Völkermord an den Juden in der Nazizeit in der SBZ/ DDR behandelt wurde, war Gegenstand zahlreicher wissenschaftlicher Abhandlungen von Philologen und Historiken. In den Jahren 1990-2000 wurden die Arbeiten von u.a. Mario Kessler, Michael Wolffsohn, Angelika Timm, Thomas Jung und Ulrike Offenberg veröffentlicht. Die dort formulierten Thesen bilden die Grundlage für diesen Artikel. Er schildert die Lage der jüdischen DDR-Bewohner, die sich nach Kriegsende für das Leben in Deutschland entschieden haben. Es wurde versucht, die Kluft zu (...) veranschaulichen, die zwischen der von der Regierung betriebenen Propaganda und dem ostdeutschen Alltag bestand. Die im Artikel dargestellten politischen und ideologischen Grundlagen des ostdeutschen Staates, wie auch die Realität, in welcher die jüdischen DDR-Bürger gelebt haben, bilden wichtige Kontexte für das Schaffen von Jurek Becker. Die angedeuteten Probleme, die die jüdische Bevölkerung zu bewältigen hatte, wie etwa die Unmöglichkeit der Identitätsfindung in der scheinbar homogenen, in Wirklichkeit jedoch deutlich geteilten ostdeutschen Gesellschaft, kommen hier zur Sprache. Da Becker selbst von diesem Problem betroffen war, inspirierte ihn dies bei der Arbeit an seinen Romanen, Erzählungen und anderen literarischen Texten, die oft autobiographische Züge aufweisen. Dies wurde am Beispiel von Bronsteins Kinder dargestellt. Die existenziellen Probleme der jüdischen Bevölkerung wurden hier in Verbindung mit der Kritik der ostdeutschen Gesellschaft geschildert. "Time. Perception. Imagination. Phenomenological Studies on the Question of Time by Augustine, Kant and Husserl". (rus), SPb, 2013. Summary: The monograph is devoted to the key elements of the philosophy of time which determine the necessity of historicism in the analysis of subjectivity. The main idea which defined the composition and design of this work is to trace how the Kantian definition of time as the “form of inner sense” is revealed in Husserl’s phenomenology. The original intention was to understand (...) all three components of this definition. Firstly, what is the inner form, in terms of phenomenology, what are the principles of its constitution and how one can talk about the property of formation? Secondly, what is the meaning of the term "inner" in philosophy, where the division into internal and external has always been a formality, not affecting the essence of things? And finally, what sort of “sensibility” is assumed in transcendental science, bound to become the basis of understanding the history and culture. Presumably, these three Kantian concepts constituted the original plan to analyze the nature of cognitive capabilities of the subject, claiming the gnoseological stage on which the philosophy of time is unfolded. In other words, this work deals with the historical and philosophical analysis of the phenomenological principles by which the concept of time as developed in the twentieth century emerged in the framework of phenomenology. The analyze of the structure of the subject assumes that time, perception and imagination combine in a special type of inner synthesis, which may not be relevant to certain aspects of the method but maintain the basis for a kind of anthropology of time, in continuation of the traditional “inner” contemplation. I consider the inner structure of time with the account of philosophy of St. Augustine, who in many respects not only anticipated the conclusions of phenomenology, but also in his reflections encompassed deeper layers of inner experience. The first chapter is devoted to the doctrine of St. Augustine, in which the theory of time is analyzed in conjunction with the doctrine of “inner word”, specifics of memory representations and notion of inner sense. Additionally, I consider St. Augustine’s reflections about numbers that constitute the basis of aesthetic perception of music (De Musica). Thus, the philosophy of St. Augustine already covers the whole spectrum of anthropology of time, including the question of relation between time and eternity, which remains practically unexplored in phenomenology and serves as the proof of that in interactions between philosophy and theology the tradition remains important. The second chapter of this study is devoted to analysis of the transcendental aesthetic of Kant, which includes all the methodological possibilities of considering the category of time as a formal condition for any experience, consequentially serving as a foundation for further logical development by Husserl, which includes the critical disengagement of the founder of phenomenology from Kant's transcendentalism. Particular attention is paid to the origin of the concept of inner sense, as well as possible interpretations of the function of imagination, which as a transcendental ability remains the most interesting type of synthesis. Handwritten fragments of Kant’s works are also of interest to the character of the imagery as considered in detail by Husserl. Chapter three discusses the phenomenology of inner time consciousness, represented in those important aspects, without which it is impossible to speak about the internal structure of temporal experience - the subjectivity of time, retention, "living present", and the character of synthesis. Particular attention is paid to Husserl's polemics with those representatives of psychological branch in the studies of consciousness, whose ideas greatly influenced the very motivation for creating the method. Apart from the well-known criticism of Brentano, the third chapter highlights the rarely analyzed psychological ideas that motivated the choice of Husserl’s terminology - the "Präsenzzeit” by W. Stern, the "psychological analysis" by A. Meinong, and the “fusion” (Verschmelzung) by K. Stumpf. Chapter four deals with the need to analyze the specifics of image as an element of consciousness and imagery as such, which includes a system of objectified acts. Thus is revealed the very nature of synthetic connections in the acts of consciousness, as well as the presumably imaginative character of the constitution of temporal form. (shrink)

Wydane w latach 1782-1786 Niemieckie baśnie ludowe Johanna Karla Augusta Musausa, znanego oświeceniowej publiczności autora poczytnych Podróży fizjognomicznych, przyjęto początkowo entuzjastycznie, uznając je za wyjątkowo udaną formę literaryzacji elementów baśniowej tradycji ustnej i pisanej oraz podkreślając walory "dowcipnej" narracji. W wieku XVIII pojęcie "baśni" (Miirchen) miało szerokie znaczenie. Słowniki i leksykony wskazują na to, iż pojęcia: "bajka" (Fabel), "baśń" (Mcirchen), "podanie" (Sage) i "legenda"(Legende) mogły być używane zamiennie. Musaus definiuje we wstępie do swego zbioru zatytułowanym Słowo wstępne do pana Dawida (...) Runkela, będącym humorystyczną autoprezentacją pisarza i jego baśni, pojęcie "baśni" jako "poetę cudowną" (wunderbare Dichtung), przemawiającą w sposób szczególny do wyobraźni czytelnika. Taka definicja baśni pozwoliła zebrać Musausowi w swym zbiorze teksty, które według dzisiejszych kryteriów określono by w większości jako podania. Ukazanie się w roku 1812 pierwszego tomu Baśni dziecięcych i domowych braci Jakuba i Wilhelma Grimmów było wydarzeniem epokowym w historii baśni. Baśnie braci Grimmów na długo stały się normą o uniwersalnym znaczeniu, według której oceniano baśniowość tego typu utworów. Podług romantycznej miary Grimmów oceniano również oświeceniowe baśnie Musausa, a ocena ta najczęściej nie wypadała pozytywnie. Artykuł przedstawia recepcję Niemieckich baśni ludowych Musausa u braci Grimmów, Ludwika Tiecka, Achima von Arnima i u nawiązującego bezpośrednio do romantycznych koncepcji Grimmów Ludwika Bechsteina, uwypuklając na ich przykładzie różnicę w ujęciu fenomenu baśniowości w oświeceniu i romantyzmie. Beniński filozof Paulin J. Hountondji jest autorem teorii systemu, która aspiruje do przynajmniej częściowego wytłumaczenia przyczyn złej kondycji afrykańskich społeczeństw i państw. Afrykański społeczno-polityczny stan rzeczy charakteryzuje, zdaniem Hountondjiego, przede wszystkim wadliwa organizacja struktur instytucjonalnych państw oraz codziennego życia Afrykanów. Hountondji krytykuje liczne wady afrykańskiej rzeczywistości - w tym inercję instytucji, działania pełne absurdów, marnowanie czasu, energii i zdrowia - i zarazem poszukuje ich ukrytych, „systemowych” podstaw. W rozumieniu Hountondjiego, system to zbiór wzajemnie ze sobą powiązanych elementów organizacji afrykańskich społeczeństw. (...) Istniejący system jest kontrproduktywny dla rozwoju. Myśl Hountondjiego wydaje się być adresowana przede wszystkim do samych Afrykanów, których filozof zapewne chciałby zachęcić do przemyśleń nad tym, dlaczego nie dążą oni wystarczająco skutecznie do zmiany rzeczywistości, w której żyją. Hountondji dostrzega u Afrykanów brak „woli racjonalnej organizacji, woli wykorzystania niewielu dostępnych zasobów w najlepszy możliwy sposób i dla największego możliwego zadowolenia każdego”. Zarazem wskazuje podstawowe i niezbędne, w jego opinii, działania, które mogą prowadzić do zmiany systemu, który kreuje i utrwala afrykański stan rzeczy. (shrink)

Idea powszechności legła u samych podstaw współczesnej ochrony praw człowieka i nadal jest często podkreślana w dyskursie typu praktycznego, na różnych płaszczyznach: politycznej, moralnej czy religijnej. Jednakże trudno o koncepcję praw człowieka pozwalającą pogodzić powszechność z właściwościami prawa, z postulatami respektu dla pluralizmu ugruntowanego tak w odmienności kulturowej, jak i wolności poszczególnych jednostek ludzkich. Wziąwszy pod uwagę, że powszechność jest fundamentalnym przy¬miotem praw człowieka, kłopoty z powszechnością są kłopotami ze zbudowaniem filozoficznej koncepcji praw człowieka w ogóle. Odrzucenie powszechności jest równoznaczne (...) z odrzuceniem podstaw współczesnej koncepcji tych praw. Opracowanie zmierza do identyfikacji rozmaitych aspektów powszechności praw człowieka i do uporządkowania argumentów przytaczanych w dyskusji nad powszechnością. (shrink)

In this article, I defend the pragmatic relevance of race in history. Kant and Hegel's racist development thesis assumes that nonwhite, non-European racial groups are defective practical agents. In response, philosophers have opted to drop race from a theory of history and progress. They posit that denying its pragmatic relevance amounts to anti-racist egalitarianism. I dub this tactic “colorblind cosmopolitanism” and offer grounds for its rejection. Following Du Bois, I ascribe, instead, a pragmatic role to race in history. Namely, Du (...) Bois argues that race is an “instrument of progress” that advances emancipatory struggle. He appeals to the writing of history—or historiography—to cultivate group consciousness of historical memory in order to strengthen intragroup bonds among the racially oppressed, especially black Americans, and create intergroup bonds that reconstruct the republic on the basis of universal ideals. I detail Du Bois's defense of the black struggle for freedom in the wake of the U.S. Civil War to provide a concrete illustration of “spirit” in American history. (shrink)

Heideggers Der Ursprung des Kunstwerks ist einer der wichtigsten Beiträge zur philosophischen Ästhetik, zudem ein Schlüsseltext für Heideggers gesamtes Denken. Aber nicht ganz zu Unrecht gilt die Lektüre bei Studierenden und Anfängern im Denken Heideggers als schwierig. Dieser Band soll das Verständnis des Kunstwerkaufsatzes anleiten und erleichtern: In 18 Beiträgen stellen die Autoren in ihren Interpretationen die Grundgedanken und philosophischen sowie literarischen Quellen des Textes vor, verorten ihn in Heideggers Werk und und skizzieren seine philosophische Wirkung. Dieser erste kooperative Kommentar (...) zum Kunstwerkaufsatz schließt an das Vorwissen und die Interessen seiner Leser in vielerlei Hinsichten an, ermöglicht so einen leichteren Einstieg in die Lektüre und erschließt den Text aus verschiedenen Perspektiven der Philosophie und der Kunstwissenschaft. -/- Einen ersten Schwerpunkt bilden dabei thematische Einführungen, die das Verhältnis von Kunstwerken zu anderen Dingen, zur Technik, zur Natur, zu Wahrheit und Geschichte bestimmen. So erläutern die Beiträge Heideggers Bestimmung der Gestalt von Kunstwerken und seine These vom Vorrang der Dichtung. Ein zweiter Teil geht den Quellen des Kunstwerkaufsatzes in der Philosophie (Aristoteles, Heraklit, Hegel) und in der Literatur (Hölderlin, Meyer, Rilke) nach. Das Metameta-Paradox ist darauf zurückzuführen, daß man die Eigenständigkeit jeder Realität annimmt, während es in Wirklichkeit nur eine Realität gibt, zu deren Beschreibung eine Sprache genutzt wird, die jedoch keine Metasprache im Verhältnis zu sich selbst sein kann, weil sie aus Elementen besteht, die zu gleicher Klasse angehören. Daher ist jede Beschreibung der Realität der Realität untergeordnet, und ihre Beschreibung sowie die Beschreibung ihrer Beschreibung u.s.w. dürfen nicht als eigenständige Klassen im Sinne der Gruppentheorie eingestuft werden.

Niniejszy tekst jest poświęcony kwestii nicości w myśleniu Heideggera. Dokonana w Byciu i czasie analiza struktury Dasein wydobywa na jaw wiele jej istotnych aspektów, a właściwie egzystencjałów, z których jednym byłaby trwoga. W trwodze świat „staje się” nicością, ukazuje się w sposób pusty i bezlitosny, ale zarazem odsłania to Dasein możliwość jego autentycznej egzystencji, możliwość zin¬dywidualizowanego bycia-w-świecie. W wykładzie Czym jest metafizyka? Heidegger powraca do problematyki nicości, rozumiejąc ją już inaczej niż czyniła to metafizyka: mianowicie nicość była warunkiem umożliwiającym jawność (...) bytu dla człowieka. Bycie: nicość: to samo – ogólnie rzecz ujmując, Heidegger będzie twierdził, że nicość przynależy do bycia, co syntetycznie wyraża właśnie ta jego późna formuła. Ponieważ kwestia bycia jest ściśle związana z kwestią czasu, stąd problematyka nicości łączy się najściślej u Heideggera z problematyką temporalności, temporalności ujmowanej – co koniecznie trzeba podkreślić – ekstatycznie. Temporalizacja byłaby według Heideggera wolną oscylacją pierwotnej czasowości otwartego horyzontu, co umożliwiałoby światowanie (Welten), czyli wchodzenie bytów w świat. Z tej perspektywy, w wykładzie Metafizyczne podstawy logiki, nicość jest określana jako nihil originarium. Świat to nicość, która wydarza się wraz i dzięki pierwotnemu czasowaniu się, co późny Heideggera będzie także rozumiał jako czwarty wymiar czasu (Czas i bycie). Nicość jest także tematyzowana przez Heidggera w Przyczynkach do filozofii, gdzie jest z kolei objaśniana jako istotowa wibracja (Erzitterung) Bycia (Sein). Podczas seminarium w Le Thor (1969) Heidegger powie, że w wydarzaniu (Ereignis) nie zostało już pomyślane nic greckiego. Wydarzanie nie „jest”, ale „daje”, „wydarza” bycie i czas. Bycie to jednak nie metafizycznie rozumiana obecność. Bycie to także nie nieobecność, nie sprowadza się ono bowiem do metafizycznie rozumianej nicości, nicości pojmowanej w opozycji do bytu, ale to nicość w sensie nihil originarium, nicość w sensie temporalnym, a może nawet i energetycznym. Tak ujmowana przez Heideggera nicość zdaje się i tak jednak „zanikać” w nieprzedstawianym, niewyrażalnym wydarzaniu, wydarzaniu uchodzącym za ostatnie „słowo” jego filozofii. (shrink)

This paper concerns an important and exciting book by Marek Dobrzeniecki Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga [Hiddenness and the Incarnation: A Theistic Response to John L. Schellenberg’s Argument for Divine Nonexistence]. After a brief discussion of the content of the book’s chapters, critical remarks are presented. They concern the adopted method and approach to Schellenberg’s philosophy in general and the argument from hiddenness in particular. The conceptual framework serving as a typologization of (...) the propositional dimension of the phenomenon of theistic belief/faith is dubious and requires in-depth research. It is worth considering the possibility of asymmetry of the attitudes of belief/faith and unbelief, which requires consideration in the reasoning whose legitimacy would assume the transfer of features from one to the other and the negation functor. Regarding the voluntarism of belief in God, the paper suggests that extreme, purely intellectual, and purely volitional positions should be considered, as well as moderate and mixed ones. It is argued extensively that Dobrzeniecki’s criticism against the arguments of Rea and Mourad is not conclusive. Just the possibility of voluntariness of disbelief undermines the validity of Schellenberg’s argument and should therefore be ruled out as much as possible. The paper suggests supplementing Dobrzeniecki’s approach with a ‘trans-paradigmatic’ approach consisting of external criticism, which, in the light of Schellenberg’s arguments being probably incompatible with the described phenomenon of religious belief in God, leads to a modification of the theoretical apparatus of Schellenberg’s paradigm. Such a modification deprives the latter’s argument of justification. --- Niniejszy artykuł dotyczy ważnej i interesującej książki Marka Dobrzenieckiego Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga. Po krótkim omówieniu zawartości poszczególnych rozdziałów książki prezentuję swoje uwagi krytyczne. Dotyczą one przyjętej metody i podejścia do filozofii Schellenberga w ogólności, a argumentu z ukrytości w szczególności. Wątpliwa i wymagająca pogłębionego badania jest siatka pojęciowa pełniąca funkcję typologizacji propozycjonalnego wymiaru fenomenu wiary teistycznej. Warta rozważania jest możliwość niesymetryczności postaw wiary i niewiary, co wymaga uwzględnienia w rozumowaniach, których zasadność zakładałaby przenoszenie cech z jednej na drugą oraz funktora negacji. W sprawie woluntaryzmu wiary w Boga sugeruję, że należy rozpatrywać nie tylko stanowiska skrajne, czysto intelektualistyczne i czysto wolicjonalne, ale także u miarkowane i mieszane. Argumentuję szeroko, że krytyka Dobrzenieckiego skierowana przeciwko argumentom Rea i Mourada nie jest konkluzywna. Argumentuję, że samo możliwość woluntarności niewiary podważa zasadność argumentu Schellenberga i dlatego powinna ona być wykluczona w sposób maksymalnie możliwie uzasadniony. Sugeruję uzupełnienie podejścia Dobrzenieckiego o podejście ‘transparadygmatyczne’ polegające na rodzaju krytyki zewnętrznej, która w świetle nieprzystawania argumentacji Schellenberga do opisywanego fenomenu prowadzi do modyfikacji aparatu teoretycznego paradygmatu Schellenberga. Taka modyfikacja odbiera argumentowi tego ostatniego moc uzasadniającą. (shrink)

Modern politika tanımlarında hâkim kavramlardan söz etmek olasıdır. Bu kavramlar arasında; iktidar, şiddet, hiyerarşi, güvenlik, kaynak dağıtımı öne çıkanlardır. Politika, birçoklarına göre, iktidarın ve gücün nasıl dağıtıldığı ve kullanıldığıyla ilgilidir. Politika, salt iktidarla ilişkili bir biçimde tanımlandığında, şiddet, politikanın etkili araçlarından birisi gibi görünür. Hatta daha ileriye gidilerek, şiddet, iktidarın dışavurumu olarak görülür. C. W. Mills’in, “siyaset iktidar mücadelesinden ibarettir; iktidarın nihai biçimi ise şiddettir” ya da Mao Zedong’un “siyaset, kan dökülmeyen savaş; savaş ise kan dökülen siyasettir” sözleri, siyaset ile (...) şiddetin birlikte düşünülmesinin en tipik örnekleridir. Hükmetme sanatı, iktidar elde etmek ve iktidarı azamileştirme biçiminde tanımlanan siyasetin, şiddeti meşru görmesi kaçınılmaz görünmektedir. Bu tanımdan hareket edenler, en iyi ihtimalle, meşru ve gayrı-meşru şiddet arasında bir ayrıma yönelirler. Bu ayrım da şiddetin politik bir etkinlik olarak meşrulaştırılmasını onaylar. Siyaseti, iktidar ve şiddet üzerinden tanımlayan hâkim yaklaşıma dönük eleştiriler de vardır. Siyaseti başka türlü tanımlamanın imkânı olup olmadığı sorusundan hareket eden bu yaklaşımlar, alternatif bir politika anlayışı ortaya koymaya çalışırlar. Bu tip politika anlayışına sahip düşünürlerin başında Hannah Arendt gelmektedir. Sahte ve sahici politika ayrımından hareket eden Arendt, sahici politikanın merkezine eylemi yerleştirir. Eylem, insanların kendilerini gerçekleştirmesini, sahici kılmasını, diğer insanlarla birlikte yaşamasını sağlayan süreçleri başlatma ve kesintiye uğratma yetisidir. Bu bakımdan politika, birlikte yaşama, kamusal meseleler hakkında tartışma ve ortak dünya için eylemde bulunma etkinliğidir. Kamusal alanda, eşitlerinin gözü önünde eylemde bulunma kişinin benzersizliğini göstermesine neden olur. Bu bakımdan, eşitlik ve çoğulluk politikanın koşuludur. Arendt, sadece eylemi değil, “söz”ü de politikanın merkezine yerleştirir. Arendt için politik yaşam, eyleme dökülmüş söz üzerine kuruludur. Politikanın söz ile ilişkilendirilmesi, açıktır ki, şiddeti dışlar. Arendt’e göre şiddet dilsizdir ve hiçbir zaman politikanın merkezi olan eyleme dökülmüş sözün neden olduğu süreç başlatma ve yaratıcı olma özelliğine sahip değildir. Bu çalışmanın amacı, politikayı Arendt’le birlikte yeniden düşünmenin, yeni bir politika tanımı için sağlayacağı imkânları tartışmaktır. (shrink)

Die anhaltende Popularität von juristisch geprägter Literatur zeigt, dass das Ringen um die Gerechtigkeit im Recht ein brisantes Thema ist, das gesellschaftliche Aufmerksamkeit auf sich zieht, provoziert und immer wieder neu zum Nachdenken herausfordert. Zeitgenössisch sind es Autor*innen wie Juli Zeh, Bernhard Schlink, Georg Oswald oder Ferdinand von Schirach (sogenannte Dichterjurist*innen 1 ), die die Frage nach Recht und Gerechtigkeit literarisch verbinden und deren Problemkontexte beleuchten. Juli Zeh lässt ihrem Roman Spieltrieb die Erzählerinstanz sprechen: „Das Recht ist kein Kreißsaal für (...) die Gerechtigkeit […]“ (2013, 518). Auch Ferdinand von Schirach bemüht sich herauszustellen, dass für ihn Recht nicht gleich Gerechtigkeit bedeutet. Als Strafverteidiger sagt er über die Justiz: „[W]ir sprechen […] nicht Gerechtigkeit, sondern Recht“ (Heise 2009).3 In seinen Bestsellern (angefangen von z. B. Der Fall Collini über Terror bis zu seinem neusten Stück Gott) provoziert er das Gerechtigkeitsempfinden seiner Leser*innen und lässt sie am Ende gerne selbst das Urteil fällen. In Terror (2016) soll das Publikum als Jury selbst entscheiden, ob der Kampfpilot das entführte Passagierflugzeug, das auf ein voll besetztes Fußballstadion zugesteuert ist, hätte abschießen dürfen. Hier geraten u. a. die Gewissensentscheidung des Piloten und die Rechtsgrundlage in einen Konflikt. Nicht selten macht er den Leser*innen das Recht schwer erträglich, wenn er z. B. wie im Erzählband Schuld (2017) auf brutale Weise beschreibt, wie eine minderjährige Kellnerin auf einem Volksfest von einer Gruppe von Männern vergewaltigt wird, aber aus Beweismangel letztendlich keiner dieser Männer schuldig gesprochen werden kann. In der Literatur werden vielfältige Zugänge zum Verhältnis von Recht und Gerechtigkeit eröffnet – wie kann sich die christliche Sozialethik positionieren? (shrink)

Prezentowana książka jest pierwszą monografią w sposób całościowy omawiającą Preambułę Konstytucji Rzeczypospolitej Polskiej z 2.4.1997 r. Dużo miejsca poświęca genezie tekstu - czytelnik znajdzie zgłoszone projekty oraz szerokie omówienie prac Komisji Konstytucyjnej Zgromadzenia Narodowego. W centrum uwagi znalazły się aksjologiczne podstawy całego polskiego systemu prawa oraz refleksja nad wartościami fundującymi porządek prawny w ogóle. Autor omawia poszczególne wartości, uwzględniając ich oddziaływanie na orzecznictwo, zwracając uwagę również na przyjęte przez ustrojodawcę rozstrzygnięcia dotyczące pozaprawnego ugruntowania wartości konstytucyjnych. Podejmuje także problem normatywnego charakteru (...) Preambuły. Książka adresowana jest w sposób szczególny do wszystkich zainteresowanych prawem konstytucyjnym, przede wszystkim w kontekście zagadnień filozoficznoprawnych. Pogłębione rozumienie Preambuły Konstytucji jest istotne także dla wszystkich obywateli, gdyż wskazuje ona na podstawowe wartości leżące u podstaw wspólnoty politycznej. (shrink)

In the years before the Second World War, Rudolf Carnap and Hans Reichenbach emigrated to the United States, escaping the quickly deteriorating political situation on the continent. Once in the U. S., the two significantly changed the American philosophical climate. This two-part paper reconstructs Carnap’s and Reichenbach’s surprisingly numerous interactions with American academics in the decades before their move in order to explain the impact of their arrival in the late 1930s. Building on archival material of several key players and (...) institutions, I take some first steps toward answering the question why logical empiricism became so successful in the United States after the War. This first part reconstructs Carnap’s development between 1923, when he first visited New York, and 1936, when he was offered a position at the University of Chicago. I describe Carnap’s first substantive contacts with American philosophers as well as the events leading up to his decision to emigrate. In addition, I argue that some of Carnap’s work from the mid-1930s—in particular “Testability and Meaning”—can be better understood if we take into account his attempts to correct the American narrative about logical positivism and his increasingly desperate efforts to find a position in the United States. Autorka chciałaby prześledzić niektóre schematy cielesnych zachowań i podstaw w odniesieniu do indywidualnego śpiewu oraz do gry na wiolonczeli w odniesieniu do pojęć piękna, wolności i przemocy. W rezultacie tych analiz chciałaby wskazać na przełamywanie zastanych cielesnych schematów na rzecz muzyki (lepszej gry, lepszego dźwięku, lepszego brzmienia) np. u wirtuozów instrumentalistów Mstislava Rostropovicha czy 2 Cellos a także we współczesnej pedagogice muzycznej oraz u śpiewaków wirtuozów muzyki popularnej, np. Whitney Houston. Zastanawianiu się nad tym, jak dochodzi do przełamania oraz „uwolnienia (...) się” ciała, o ile rzeczywiście z tym mamy do czynienia, w ekspresji wykonania towarzyszyć będzie pytanie o to, w jaki sposób i o ile to właśnie ciało/cielesność (rozumiana tutaj organicznie i funkcyjnie) dyktuje konkretne zachowania wyzwalając się stopniowo z nawyków i dyktatów kultury, a na ile należałby tutaj mówić o rewolucji estetycznej i zastępowaniu jednych schematów (a może ideałów) przez inne. Cílem článku je ukázat, že německá raná romantika, která položila filosofické základy romantického hnutí, nebere příklon k subjektivitě prožívání jako odklon od poznání, nýbrž jako jiný způsob poznání. Romantická niternost nachází svůj protějšek ve zkušenosti světa, jemuž umění dokáže propůjčit hlubší význam než racionální filosofie a věda. Tento nový pohled na poznání je romantiky použit jak na výklad přírody, tak duchovní lidské skutečnosti. Článek upozorňuje na to, že vedle dědictví spinozismu měla romantická epistemologie důležitý zdroj v některých úvahách Kantovy Kritiky (...) soudnosti. Tato vazba je sledována zvláště na příkladu filosofie umění F. W. J. Schellinga. Argumentace článku je rozvinuta v kritické konfrontaci se subjektivistickou interpretací romantiky H.-G. Gadamera, čímž se ozřejmuje její širší epistemologický dosah i aktuálnost. Návaznost německých romantiků na Kantovu Kritiku soudnosti se spíše než tendencí k subjektivizaci estetiky projevovala ve snaze o estetizaci poznání. (shrink)

Autorka przedstawia analizę pojęcia wstrząsu jako kategorii estetycznej użytej przez Th. Adorno w kontekście niemożności odbioru muzyki nowej. Nawiązując do Filozofii nowej muzyki oraz Teorii estetycznej autorka wyznacza kilka sposobów opisu i rozumienia wstrząsu, jakie znaleźć można u Adorno. Przy okazji śledząc tok myślenia filozofa zadaje sobie pytanie o to, czy wstrząs, o którym pisze Adorno jest zasadniczo czymś negatywnym, czym też może autor widzi w tym, gwałtownym sposobie reakcji na muzykę nową – ratunek.

„Skoro powszechnie przyjmuje się, że sumienie jest suwerenne, to nie wiadomo, po co lekarz miałby uzasadniać pisemnie swój światopogląd” – napisała Naczelna Izba Lekarska w skardze do Trybunału Konstytucyjnego. Trybunał tę część skargi oddalił w wyroku z 7 października 2015 r., ale stwierdził, że „Celem prowadzenia dokumentacji medycznej nie jest (…) utrwalanie na piśmie poglądów filozoficzno-prawnych lekarza”. Uznał też, że uzasadnienie „powinno mieć charakter medyczny, a nie służyć wyjaśnieniu światopoglądu lekarza, czy też wskazaniu zasady moralnej leżącej u podstaw jego zachowania”. (...) Podobną interpretację akceptuje wielu polskich prawników, twierdząc, że skoro sumienie czy światopogląd lekarza są „indywidualne”, „autonomiczne”, „suwerenne”, to merytoryczne powody odmowy wykonania świadczenia medycznego nie mogą podlegać jakiejkolwiek ocenie i kontroli. Linden Lab studies massive online game "Second Life" unexpectedly gained worldwide fame after a few years after release. To the surprise of many game has met with great interest, despite the lack of promotional campaigns. It can be assumed that the reason why "second life" reached a wider audience was a special type of offered entertainment. Network game proved to be no longer a game that was known so far, but an example of a mass media, whose central element is (...) a dynamic virtual world which is an extension of our "first" reality. "Second Life" has the potential, which is challenging the widely shared rules could shake the foundations of the social world. This program is currently the most advanced example of a virtual economy. Unlike many other massive online games and their predecessors, this game is entirely based on the principles of virtual property ownership, as well as rules of conduct virtual business and service, and finally also the consumption of goods. Users of the game, just like the person providing the data in the framework of social networking sites maintained in the mainstream of Web 2.0, user-generated content constituting the virtual world, which can trade content with others linden virtual dolars that can be exchanged to real U.S. dollars. The increase in popularity of "Second Life" brings to mind the vision of the possibility of creating a better place to live for many people. Closer analysis of this phenomenon does not allow for such statements. In the following instances will be presented: information about the growth of the global market for online games and its consequences, the distinguishing features of "Second Life" from traditional online games, virtual elements of the impact of economics on social life, the concept of entertainment as a job stream properties Games 2.0 and contentious issues, which produces "second life". ** Masowa gra on-line "Second Life" studia Linden Lab nieoczekiwanie zdobyła sławȩ na całym świecie po kilku latach od premiery. Ku zaskoczeniu wielu tytuł spotkał siȩ z ogromnym zainteresowaniem mimo braku akcji promocyjnych. Można przypuszczać, że powodem dla którego "drugie życie" dotarło do szerszego grona odbiorców był szczególny typ zaoferowanej formy rozrywki. Sieciowa gra okazała siȩ nie być już gr¸a} jak¸a} znano do tej pory, lecz przykładem środka masowego przekazu, którego centralnym elementem jest dynamiczny wirtualny świat stanowi¸a}cy przedłużenie naszej, "pierwszej", rzeczywistości. "Second Life" kryje w sobie potencjał, który podważaj¸a}c podzielane powszechnie reguły może wstrz¸a}sn¸a}ć posadami świata społecznego. Program ten jest obecnie najbardziej zaawansowanym przykładem wirtualnej gospodarki. W odróżnieniu od wielu innych masowych gier on-line i ich poprzedniczek pozycja ta w całości opiera siȩ na zasadach posiadania wirtualnej własności, jak też regułach prowadzenia wirtualnej działalności gospodarczej i usługowej, i wreszcie takiej też konsumpcji dóbr. Użytkownicy gry, podobnie jak osoby udostȩpniaj¸a}ce dane w ramach internetowych serwisów społecznościowych utrzymanych w nurcie Web 2.0, generuj¸a} treści tworz¸a}ce wirtualny świat, treści którymi mog¸a} handlować z innymi pobieraj¸a}c za nie opłaty w wirtualnych dolarach lindeńskich wymiennych na realne dolary amerykańskie. Wzrost popularności "Second Life" przywodzi na myśl wizjȩ możliwości stworzenia lepszego miejsca do życia dla wielu ludzi. Bliższa analiza tego zjawiska nie pozwala już na takie stwierdzenia. W dalszej czȩści wyst¸apienia przedstawione zostan¸a: informacje o wzroście globalnego rynku gier on-line i jego konsekwencjach, cechy odróżniaj¸ace "Second Life" od tradycyjnych gier sieciowych, elementy wpływu wirtualnej gospodarki na życie społeczne, pojȩcie rozrywki jako pracy, właściwości nurtu Games 2.0 oraz sporne kwestie, jakie wywołuje "drugie życie". Susanne K. Langer is best known as a philosopher of culture and student of Ernst Cassirer. In this chapter, however, I argue that this standard picture ignores her contributions to the development of analytic philosophy in the 1920s and 1930s. I reconstruct the reception of Langer’s first book *The Practice of Philosophy*—arguably the first sustained defense of analytic philosophy by an American philosopher—and describe how prominent European philosophers of science such as Moritz Schlick, Rudolf Carnap, and Herbert Feigl viewed her (...) as one of the most important allies in the United States. In the second half of this chapter, I turn to Langer’s best-selling *Philosophy in a New Key* and reconstruct her attempts to broaden the scope of the, by then, rapidly growing U.S. analytic movement. I argue that her book anticipated various developments in analytic philosophy but was largely ignored by her former colleagues. I end the chapter by offering some clues as to why New Key did not incite the same laudatory responses from analytic philosophers as her earlier work. (shrink)

Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje się (...) do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności. Opracowanie zmierza do określenia paradygmatu rozumienia klauzuli dobra wspólnego zawartej w art. 1 Konstytucji z 1997 r. i treści sformułowanej w nim zasady. Argumentuje się, że – m. in. ze względu na zachowanie materialnej tożsamości konstytucji – kluczowa dla realizacji postawionego celu jest analiza prac przygotowawczych. Analiza ta pozwala na postawienie tezy, że dobro wspólne to – określana na płaszczyźnie wspólnoty politycznej – suma warunków życia społecznego umożliwiających i ułatwiających rozwój wszystkich członków tej wspólnoty i tworzonych przez nich społeczności. Szeroko (...) przedstawiona jest szersza, sięgająca starożytności, filozoficzna tradycja ideowa leżąca u podstaw identyfikowanego paradygmatu konstytucyjnego pojęcia dobra wspólnego, oraz polskie tradycje konstytucyjne powiązane z podjętą problematyką. Argumentuje się, że ustrojodawca wskazał określoną tradycję ideową jako wyznaczającą podstawowy kontekst wyznaczający rozumienie klauzuli dobra wspólnego oraz wprost zdystansował się wobec centralnych elementów ujęcia dobra wspólnego właściwego konstytucji kwietniowej z 1935 r., pozostając w tradycji, do której należała Konstytucja 3 Maja. Sformułowana w art. 1 Konstytucji z 1997 r. zasada dobra wspólnego głosząca, że „Rzeczpospolita Polska jest dobrem wspólnym wszystkich obywateli”, sytuuje dobro wspólne u podstaw całego porządku konstytucyjnego. Po zidentyfikowaniu zasadniczych elementów tej zasady argumentuje się, że jest ona zasadą pierwszą, strukturalnie powiązaną z każdym elementem systemu prawnego. Argumentuje się na rzecz tezy o integralnym powiązaniu dobra wspólnego z godnością i uznaniu wolności i praw człowieka za zasadniczy element dobra wspólnego. Opracowana koncepcja zostaje zaaplikowana do orzecznictwa Trybunału Konstytucyjnego. Przeprowadzona analiza wskazuje, że orzecznictwo to nie jest, jak dotąd, oparte na spójnej koncepcji dobra wspólnego. Nierzadko przyjmowana jest perspektywa typowa dla – odrzuconego przez ustrojodawcę – ujęcia w duchu konstytucji kwietniowej, w której dobro wspólne przeciwstawiane jest prawom człowieka; obecne są jednak także elementy typowe dla ujęcia klasycznego, w duchu Konstytucji 3 Maja. Analizę dopełniają postulaty dotyczące dalszego kształtowania orzecznictwa TK odwołującego się do dobra wspólnego. (shrink)

Friedrich Schiller wielokrotnie angażował się w walkę o wolność, co wpłynęło na jego wielką popularność wśród Żydów z Europy Środkowej. Pod koniec lat osiemdziesiątych XVIII w., gdy sztuki Schillera zyskiwały uznanie, toczyła się burzliwa dyskusja o emancypacji Żydów, a antysemityzm stawał się jednym z najbardziej rozpowszechnionych w społeczeństwie poglądów. Jednak Schiller nigdy jednoznacznie nie sięgnął po temat Żydów, w przeciwieństwie do np. G. E. Lessinga i jego sztuki Nathan der Weise. Tylko jednego z jego bohaterów – zbója Moritza Spiegelberga z (...) dramatu Räuber można by określić jako Żyda, jednak nawet badacze dzieł Schillera nie są w tej kwestii zgodni. W niniejszym artykule chcę pokazać, że temat Żydów odgrywa u Schillera także pewną rolę w jego dramacie Kabale und Liebe, a jeden z bohaterów – sekretarz Wurm, ma wyraźnie żydowskie rysy. (shrink)

Der endliche Mensch hat Probleme bei W a h r n e h m u n g oder V o r s t e l l u n g eines „unendlichen“ Raumes: als gleichzeitig oder als nacheinander. Die Vorstellung eines solchen Raumes führt für Paul Sturm zu einem Widerspruch. Dabei will er nicht stehen bleiben. Die Vorstellung dieses Raumes möchte er durch das D e n k e n „erweitern und vervollständigen“. Darin sieht er die Lösung dieses Konfliktes. Er möchte (...) das Bewusstsein dafür schärfen, dass sich das „Unendliche“ nicht vorstellen, sondern nur denken lässt. In der richtigen Formulierung der Problemstellung sieht Sturm ihre Lösung. Er legt dar, dass eine falsche Methode in der Vergangenheit stets zu einem Widerspruch führte, der sich als Sophisma (irrtümliche Schlussfolgerung) erweist.
